1. WHO WE ARE
you are contracting with Dan the tow bar man, also known as DTTM.
a sole trader based in England. References to "dan the tow bar man" "we" "our" and "us" throughout the terms and conditions refer to this company .

3. POINT OF LEGAL CONTRACT CREATING
When you place an order via our webpage contact form/email/phone call or txt and social media pages we will confirm the price at the time of contact and the available spaces for booking, once booked you will receive confirmation of your booking including the date and time,
we choose from different suppliers which include westfalia, oris, witter, brink and pct. if there is a specific make you require then please mention this at the time of booking.
when your appointment is booked you agree to pay the sum stated in your enquiry/quote on completion of the job and before the fitter leaves the fitting address, the tow bar/wiring and other accessories are purchased by dan the towbar man and remain property of dan the tow bar man until such time that the balance is cleared in full.
most vehicles will require a bumper cut to aid the fitting of your tow bar, should you not wish for any alterations to be made to your bumper then please specify this at the time of booking so we can look at alternatives, if this is not specified at the time of booking: please note alterations will be made and we cannot be liable for the costs incurred.
you should not under any circumstances arrange to use your tow bar for holidays etc. until it has been fitted and that you have tested the tow bar and electrics with your cycle carrier, caravan or trailer.
these terms are the only terms upon which dan the tow bar man will contract with you for the purposes of its services via our website related social media or the contact details above. they shall govern the contract to the entire exclusion of all other terms and conditions.
dan the towbar man retains the right to refuse to accept your order solely at its discretion, if there's concern that an attempt to place an order dishonestly, fraudulently, by attempting to use stolen payment details or impersonating someone else. then we will carry out additional checks and alert external authorities. we reserve the right to refuse to serve anyone without further explanation.
4. BOOKING FOR MOBILE FITTING
our staff treat all customers with the upmost respect, and we expect the same in return. if you or anyone with you is rude or aggressive to our staff/fitters at any point, your booking will be cancelled immediately, and any further services will be refused.
4a. BOOKING A TIME AND DATE
we will always endeavour to honour your selected time and date however. in some cases we may need to re-schedule due to stock availability, we will always try and give you as much notice as possible.
4b. ONCE BOOKED
our fitter will contact you the day before to confirm your appointment slot. this is normally either 9am or between 12-1pm.
please allow for the vehicle to remain free for up to 4 hours after your fitters scheduled time to allow us to carry out the work needed. we will always try to ensure that our fitters arrive on time and complete the job within the estimated time frame stated above. however, the time of booking shall not form a contractual term. its important to remember that arrival times are an estimate and can change due to traffic or problems beyond our control, we will however inform you as soon as is practical of any delays or problems.
5. KEY LIMITATIONS TO OUR WORK
1. you must ensure the safety of our fitters, we can not complete any work on a busy road, multi storey building or at height, our fitters need to be able to carry out work in a safe area without risk of harm to them selves or the vehicle.
2. our fitters will need to park there vehicle behind or besides your vehicle in order to complete the work, our fitters need adequate room to work on your vehicle and to manoeuvre to there own van to have access to tools etc to complete the fitment.
3. we cannot fit tow bars or accessories to any vehicle parked on double yellow lines, or any of the such which breaks the law as per DVLA laws.
4. most vehicles will require a bumper cut to aid in the fitment of a tow bar, should you not wish to have a bumper cut then please state this at the time of booking to allow us to find alternatives should these be available, please4 note alterations will be made and we cannot be held liable for the costs incurred.
images/a damage logging sheet will be filed to identify existing damage or vehicle faults before the fitting takes place, we exclude all liability for repair of damage, weather visible or non visible, existing before we began to work on your vehicle.
this also applies to the exhaust system of your vehicle, in most cases the exhaust will need to be lowered to gain access to fit your tow bar, we will not be liable to replace exhaust parts where damage occurs due to pre existing rust/corrosion of the exhaust system.
this also applies to the bumper of your vehicle, where a bumper cut is required our fitter, if its possible to do so will talk about this before installation, if in doubt please contact us to discuss the bumper cut prior to the booked fitment.
please check before booking a tow bar appointment that your vehicle has a towing capacity, as we cannot legally fit a tow bar to a vehicle if not, we recommend you check the vehicles vin plate or logbook which will tell you your towing capacity in KG. a call out fee will be applied if our fitter attends your appointment and your vehicle doesn't have a towing capacity.
the fitting of a tow bar to your vehicle will be subject to a visual inspection before work commences, this is to ensure that we have the correct part/parts needed for the vehicle. if during fitting it becomes apparent that further work or parts maybe needed we will advise you before proceeding further.
we are unable to fit a towbar to corroded metal or damaged metal, if we find your vehicle to be corroded/damaged around the towbar mounting points we will stop work and discuss options with you. at this point you can request that no further work is carried out and you will only be liable for our costs incurred by us.
6. OUR LIABILIY TO YOU
dan the towbar man will not be held liable for any economic losses arising in any manner whatsoever due to delays to, or complications with, fulfilment of an order provided that nothing in these terms limits or excludes dan the towbar mans liability for death or personal injury caused by its proven negligence. this includes any losses incurred from missed holidays, or caravan site deposits etc.
we will carry out and provide our service to the best of our ability, however sometimes damage can occur when installing a towbar to your vehicle, in this event we will repair your vehicle to the condition prior to the damage occurring. provided there is sufficient proof that damage occurred during our works. this must be reported via email to danthetowbarman@yahoo.com no later than 7 days from the original fitting date. in this email you must confirm your vehicle registration details along with your proof of receipt, your full name, address and any photos relating to the damage.
you acknowledge that the cost to us of repairing your vehicle in the event that we damage it is likely to exceed the amount we are payed for our service. you agree that our total liability to you both for any service failure or vehicle damage is limited to;
the total cost of repairing any damage we cause to your vehicle.
except as stated above, you agree that unless we have written to yo to confirm otherwise before we begin work, you and dan the towbar man do not intend that dan the towbar man reimburse or compensate you for loss of income, loss of use of your vehicle, costs or expenses incurred from loss of your vehicle, loss of business or profits or pure economic loss or indirect or consequential loss suffered by you as a result of our work.
7. CANCELLATION OF WORK
you have the right to cancel your order within 14 days of booking confirmation. however where you ask us to commence with your order within this period you agree to waive this right to cancellation.
there will be no charge provided if no costs have been incurred, where costs have been incurred you will only pay for the work completed or the costs incurred.
payment for costs incurred will be required at the time of cancellation, the whole deposit will be refunded if no costs have been incurred, this is usually the standard call out fee of £50
8. PAYMENT
Full payment is to be made once the work has been completed on your vehicle, this can be made using bank transfer, cash or card payment and must be made before the fitter leaves your address unless this has been prior arranged with the management.
9.REMOVED PARTS
with the exception of warranty and service exchange parts, removed parts will be handed back to you the customer. this includes crash beams that are nit fitted with the towbar. all boxes and packaging will be removed by dan the towbar man and disposal will be in accordance with the current environmental regulations and legislative requirements.
10.REFUNDS
subject to your statutory rights (which shall not be affected by this provision) it is not possible to offer refunds after purchase for parts that have been fitted to your vehicle. in the event that you believe that the towbar or electrics are faulty. we will offer you the option of purchasing a replacement while the original part is sent to the manufacturer for testing. if the manufacturer confirms the product is faulty the cost of your replacement purchase will be refunded.
11.UPDATES TO TERMS
dan the towbar man reserves the right to amend ,add or remove the terms and conditions contained in this site without prior notice.
12. PARKING SENSORS
if your vehicle is fitted with rear parking sensors, we advise against fitting a fixed flangeball towbar, in most cases a fixed swan neck will be suitable, however this is not a guarantee and the sensors may still pick up your towbar when not towing, however the only way to fully guarantee that the vehicles sensors do not pick up the towbar neck is to fit a detachable towbar, if at your own discretion you choose a fixed swan neck or fixed flangeball towbar , dan the towbar man will not be held liable if your sensors pick up the towbar. in some cases the neck can be upgraded to a detachable and we can provide a quote for this, however this is not possible on all towbars.
13. ALKO TOW BALLS AND STABILISERS
you must inform us upon booking if your vehicle will be towing a caravan equipped with an alko stabiliser as these require extra clearance of the towbar, most fixed flangeball/swan neck and detachable swan neck are built with these clearances in mind, however not all, if you require an alko flange please ask upon booking and we can supply this, alternatively we can fit a customer provided alko ball, but in this case we cannot offer a guarantee on the towball condition, dan the towbar man will not be held liable for any damage to your car or caravan caused by a caravan equipped with an alko stabiliser and a non-compatible towball. please check your clearances between car and caravan before towing.
14. FAULTS
your towbar installation will be tested by the fitter upon completion, however if you discover a fault the please get in tough immediately to inform us.
we will then arrange for a fitter to come out and test the equipment, please note that if a fault is found to not have been caused by us or the parts fitted we will charge a call-out fee to cover our travelling costs, this will be discussed at the time of booking.
we will not pay any charges from any 3rd party unless they are agreed by us in advance. in the event that we agree to pay costs we will only pay for like for like replacement of any parts.
15.GUARANTEE
we offer a 12 month guarantee on the installation of your towbar and electrics. we shall free of charge repair any faults that appear and you report to us within this time.
In respect of any goods manufactured or supplied to us by third parties we will pass on to you (in so far as possible) the benefit of any warranty given by such third parties and will (on request) supply to you details of the terms and conditions of such warranty and copies of any relevant product information sheets, technical data sheets or product leaflets issued by third parties and you shall be solely responsible to the entire exclusion of us for complying with all of these.
Our liability under this Condition shall be to the exclusion of all other liability to you whether contractual, tortious or otherwise for defects in the goods and/or cost of labour or for any loss or damage to or caused by the goods and all other conditions, warranties, stipulations or other statements whatsoever concerning the goods, whether express or implied, by statute, at common law or otherwise howsoever, are hereby excluded in particular (but without limitation of the foregoing) we grant no warranties regarding the fitness for purpose, performance, use, nature or merchantable quality of the goods, whether express or implied, by statute at common law or otherwise howsoever.
16. GENERAL GUARANTEE
The guarantees apply from the date of original purchase.
Guarantees are not transferable and only apply to the person who made the original purchase.
Please ensure you retain your invoice, as proof of purchase is necessary before work can be carried out under the guarantees.
All parts originally purchased at dan the towbar man are covered by these guarantees, however, parts failing as a result of criminal or malicious damage, fire, theft or where the parts have been used for motorsport, hire vehicles or taxis are excluded.
If work is required to be carried out other than by dan the towbar man, approval must be obtained in advance from us. The guarantee may be invalidated when parts are repaired by a garage or individual other than by dan the towbar man. we are not responsible for any part removed from the vehicle or adjusted by any person other than dan the towbar man.
all dan the towbar mans guarantees are in addition to your statutory rights.
